Privacy. For information about how we collect and process your personal data, please read our Privacy Policy.

eSIM Data Plans. We shall provide you eSIM with Data Plans and services based on the capabilities of supplied eSIM. The eSIM includes an electronic profile which will be downloaded to your device as part of activating the Services. The volume of data available for the operation of the Services will be made clear to you during the process of purchasing or topping up the Services. The Services will be available to you for the period specified at the time of purchase. When the mentioned period expires, any remaining Services will be lost, and no refund will be payable for those unused Services. Services under these Terms are provided on a pre-purchase basis only.

Security Features. Together with the Services, we may also provide Security Features, a bundle of cybersecurity functionalities designed to enhance your online safety and user experience:

Virtual Location: This feature encrypts your internet connection by routing your online activity through a remote server. It also allows you to change your apparent location.

Ad Blocker: This functionality blocks advertisements using DNS filtering. It prevents ads hosted on remote servers from being fetched and displayed. Please note that this feature does not block ads directly hosted on the content you are accessing, so not all ads may be blocked.

Web Protection: This feature is designed to enhance your web browsing experience by blocking many trackers and potentially malicious websites through DNS filtering. These measures aim to reduce certain online risks, such as malware, phishing attempts, and data leaks, helping to create a more secure and private browsing experience. However, it does not provide absolute protection, and users should remain cautious while browsing online.

The Ad Blocker and Web Protection features may be activated by default as soon as the associated Data Plan is activated on your device. These features can be disabled at any time. The Virtual Location feature is activated only on demand.

General. The Phone Number Functionality is an optional Service that allows you to reserve a Phone Number and/or use a Phone Plan associated with that Phone Number, subject to these Terms and to the Offering (as defined below).

Functionality-specific definitions. In addition to the terms defined elsewhere in these Terms, the following capitalized terms shall have the meanings set out below:

"KYC" or "Know Your Customer" means the identity verification procedure that you are required to complete, and that must be successfully verified by adigoo, prior to (i) the disclosure to you of the specific Phone Number allocated under your Number Reservation, and (ii) the activation of such Phone Number for two-way communication, in each case in accordance with applicable telecommunications, electronic-communications, anti-money-laundering and consumer-protection laws and the rules of the relevant numbering authority and underlying carriers.

"Number Reservation" means the contractual right granted by adigoo to hold a specific Phone Number exclusively allocated to your Account for the reservation period (i) selected at purchase, or (ii) where supported, extended by way of a top-up during an ongoing Number Reservation. A Number Reservation, on its own, does not entitle you to view the specific Phone Number allocated to your Account, nor to originate or receive voice calls or SMS messages with it: the specific Phone Number is disclosed to you only upon successful completion and verification of the KYC procedure, and the ability to originate and receive voice calls and SMS messages additionally requires an activated Phone Plan.

"Numbering Resources" means telephone numbers, short codes and any other identifiers allocated under any national or international numbering plan.

"Offering" means the description of a specific Phone Number Functionality product as presented to you in the App and/or on the Website at the time of your purchase, setting out the available reservation periods (such as monthly, quarterly, half-yearly, yearly or such other periods as adigoo may make available from time to time), activation timeframes, Phone Plan options, sizes and durations, pricing, fair-use limits, geographical and country/region scope, country-, region- or user-base-specific restrictions, eligibility restrictions, plan limitations, and any other features, conditions and commercial or technical parameters applicable to the relevant Phone Number Functionality product.

"Phone Number" or "Number" means a mobile telephone number (or any other telecommunications numbering resource) made available to you by adigoo through the Phone Number Functionality, allocated by adigoo or its underlying carrier partners from the relevant national numbering plan.

"Phone Number Functionality" means the adigoo feature enabling you, subject to these Terms, to reserve and/or activate a Phone Number and, where selected by you, to use a Phone Plan associated with that Phone Number to originate and receive voice calls and SMS messages within the geographical scope specified in the Offering.

"Phone Plan" means a standard adigoo-offered or user-customized plan comprising voice minutes only, SMS messages only, or any combination of voice minutes and SMS messages, as set out in the relevant Offering.

"Quarantine" means the regulatory holding period during which a Phone Number released from your Account cannot, under applicable numbering-plan rules and operator practices, be re-allocated to any user (including, for the avoidance of doubt, you).

Extras. For certain Data Plans (whether non-subcription-based or Subscription-based), we may include complimentary Extras, such as promotional codes for additional third party based services. The type, scope, limitations, and any delayed availability of such Extras will be clearly indicated at the time of purchase on the applicable Data Plan card and during checkout. These Extras are provided by, and their availability depends on, solely third-party providers. While we do our best to ensure their availability at the time of your Data Plan activation, some may be temporarily or permanently unavailable at times. You might not always redeem Extras directly through the App - some may be delivered or redeemed via other channels, such as email or external platforms, as explained when you receive them. The availability of Extras may also change during the validity period of your Data Plan, depending on the preferences of the majority of users and seasonal factors. Please note that Extras are additional services - if one becomes unavailable, it won’t affect your core eSIM Data Plan, which remains fully functional.

Metering and billable units. Each session of data usage which you undertake will be rounded up to the nearest kilobyte.

For the Phone Number Functionality, billable units of voice and SMS usage will be determined as follows, except where the Offering expressly provides otherwise:

• (i) Voice calls. The duration of each chargeable voice call is rounded up to the nearest whole minute. For illustration, a voice call of ten (10) seconds will be deducted from your included voice allowance as one (1) minute.

• (ii) SMS messages. SMS messages are counted in accordance with established mobile-industry standards, namely: (a) for messages encoded using the GSM-7 (7-bit) character set, each segment of up to 160 characters counts as one (1) SMS; and (b) for messages encoded using the Unicode / UCS-2 (16-bit) character set - which is used automatically where the message contains characters outside the GSM-7 set (including most non-Latin scripts, certain special characters and most emojis) - each segment of up to 70 characters counts as one (1) SMS. A message that exceeds the per-segment character limit of the applicable encoding will be transmitted as multiple SMS segments and will, even though it may appear on your device screen as a single message, be deducted from your included SMS allowance (or charged at the applicable out-of-bundle rate) as two or more SMS accordingly. The encoding applied to each message is determined automatically by its content.

The Services are provided on an "as is" and "as available" basis. We do not guarantee fault-free Services, and make no warranties regarding network coverage, quality, or availability. We will make reasonable efforts to ensure continuous availability, contingent upon our and/or our partners’ network capacity and connection availability.

In case of a fault, upon awareness or notification by you, we will make reasonable efforts to promptly correct the issue.

We reserve the right to select network operators and technology partners in the best interest of our business requirements. By using Services, you acknowledge that we may disclose and use your personal data for Services provision, subject to our Privacy Policy.

Unlimited Data Plans. adigoo’s Data Plans with open data capacity (the "Unlimited Data Plans") are designed for individual, day-to-day consumer use by adigoo users. This section outlines the fair use of such plans and the actions adigoo may take to maintain service quality, access to high-speed data, network stability, and fairness for all adigoo’s users ("Fair Usage Policy") .

Consumer Use Only. Unlimited Data Plans are not intended for commercial use, resale, or use by groups of individuals. Users are prohibited from utilizing Unlimited Data Plans for the transmission of high volumes of data via access points connected to computers or other devices, or for any activities undertaken for profit or that involve continuous, heavy usage which may negatively impact the service quality for other adigoo users. The commercial resale or distribution of adigoo’s data services is strictly prohibited.

Excessive Usage. adigoo reserves the right to intervene in rare cases where a user’s usage is excessively high (e.g., significantly exceeding the average usage of 99% of other adigoo users) or negatively impacts service for others. These interventions are designed to protect the experience of adigoo’s broader user base and ensure fair access to network resources.

Full-Speed Data Allocation. Unlimited Data Plans are divided into two categories:

Regular Unlimited Data Plan.

Users on the Regular Unlimited Data Plan receive a full-speed data allocation per 24-hour period. The size of this allocation depends on the destination country, as specified in the offering. Depending on the destination, the allocation will be either 3 GB or 5 GB of full-speed data per 24-hour period. Once the applicable allocation is used within that period, data speeds will be reduced to 1 Mbps for the remainder of the 24-hour cycle. At the start of each new 24-hour cycle, the full-speed data allocation resets in accordance with the allocation assigned to the user's destination country.

Ultra Plan. Users on the Ultra Plan receive an allocation of 30 GB of full-speed data per monthly billing cycle. Once the 30 GB allocation is used within that billing cycle, data speeds will be reduced to 1 Mbps for the remainder of that cycle. At the beginning of each new billing cycle, a fresh 30 GB full-speed data allocation will be provided, provided the user maintains their Ultra Plan subscription.

Prohibited Activities. Users are strictly prohibited from using the Unlimited Data Plans for any of the following:

Bulk machine-to-machine data applications;

Continuous streaming of content intended to replace a fixed-line internet connection;

Any activities that negatively impact the performance of adigoo’s or its partners’ network or degrade the experience of other adigoo users.

Excessive tethering or sharing of data via hotspot with multiple devices or users beyond occasional personal use.

Network and Usage Monitoring. adigoo reserves the right to monitor data usage patterns and to regulate or limit excessive/abnormal use.

Traffic Shaping and Throttling. To maintain service quality, adigoo may implement traffic shaping or throttling measures during periods of high network demand or in specific locations. These measures are designed to preserve service quality, protect overall network performance and ensure fair access for all users. Such measures may include reducing data speeds, removing access to certain tariff allowances or Bolt-ons, or disconnecting the user’s eSIM service.

adigoo’s Right to Intervene. adigoo reserves the right to take appropriate measures if there is evidence of misuse or a violation of this Fair Usage Policy. In cases where a user’s data usage negatively impacts other users or network performance, adigoo may, at its discretion, take actions such as:

• (i) temporarily reducing data speeds,

• (ii) limiting access to services, or

• (iii) suspending or terminating the Services.

If a user’s usage significantly exceeds that of 99% of adigoo users, adigoo may notify the user, investigate potential violations, and take further actions, including temporary or permanent suspension of access to the Unlimited Plan. If a breach of this Fair Usage Policy is suspected, adigoo will attempt to contact the user and provide notice prior to any restrictions, limitations, or disconnections, unless extenuating circumstances (such as safety or security concerns) prevent prior notice.

Final Provisions.

This Fair Usage Policy is not exhaustive. adigoo reserves the right to amend this policy as necessary. Users are encouraged to use their Unlimited Plans responsibly to avoid negatively impacting the service for other users. Failure to comply with this policy may result in additional restrictions, or disconnection.

Local use only.

Phone Plans associated with a Phone Number are dedicated for local usage only within the country/region to which that Phone Number is allocated under the relevant national numbering plan. International, roaming, premium-rate, special-service or non-geographic traffic is not included in the standard Phone Plan and will be either blocked at adigoo’s discretion or, where supported, subject to separate terms, pricing and availability as set out in the Offering.

No ownership of Numbering Resources.

You acknowledge that Phone Numbers are Numbering Resources allocated under national numbering plans, and that no Phone Number is "sold" to you. The Number Reservation grants you only a temporary, non-exclusive, non-transferable right to use the Phone Number for the duration of the Number Reservation, subject to these Terms. adigoo and its carrier partners retain all right, title and interest in and to the Numbering Resources, subject to the rights of the relevant numbering authority.

Portability. Number portability (whether porting-in or porting-out) is not supported.

Emergency services.

The Phone Number Functionality is designed for everyday communication while you travel and is not intended as a substitute for traditional telephony. Calls to emergency or public-safety services (such as 911, 112 or other local equivalents) may not connect reliably, may not reach the appropriate local responder, and may not automatically share your location. We strongly recommend that you keep an alternative means of contacting emergency services available at all times - for example, your regular mobile line, a local landline, or the official emergency app for the country you are visiting. To the extent permitted by applicable law, adigoo is not responsible for any inability to reach emergency services through the Phone Number Functionality.

Acceptable use of the Phone Number Functionality. In addition to your general obligations under these Terms, you undertake that you shall not, and shall not allow or facilitate any third party to:

use the Phone Number Functionality for any unlawful, fraudulent, deceptive, abusive, defamatory, harassing, threatening, obscene or otherwise harmful purpose, including (without limitation):

SIM-box / interconnect bypass;

robocalling;

mass unsolicited messaging (SMS spam);

phishing, smishing or vishing;

"Wangiri" (one-ring) or similar callback fraud;

International Revenue Share Fraud (IRSF), traffic pumping or artificial inflation of traffic;

caller-ID or sender-ID spoofing in violation of applicable law;

or any usage in breach of any telecommunications, anti-spam, telemarketing, electronic-communications, data-protection, anti-money-laundering or consumer-protection laws applicable to you;

provide false, misleading, incomplete or fraudulent information in the course of the KYC procedure, or impersonate any natural person, legal entity or authority;

resell, sublicense, rent, lease, transfer, share or otherwise make available the Phone Number, the Number Reservation or any Phone Plan to any third party, or use the same for the benefit of any third party other than your own personal (non-commercial) communications;

use the Phone Number Functionality in connection with any business, automated system, application or use case that requires a regulated communications-services authorization (including bulk messaging, A2P SMS aggregation, application-to-person traffic, or emergency or critical-communications services) without adigoo’s prior express written authorization;

circumvent or attempt to circumvent any geographical, technical, regulatory or fair-use restriction that adigoo applies to the Phone Number Functionality, including the local-use limitation;

use the Phone Number Functionality in any manner that may damage, disable, overburden, impair or interfere with adigoo’s or its carrier partners’ networks or systems, or that may threaten the integrity of any numbering plan or numbering resource.

Fair use, anti-fraud and anti-abuse monitoring. adigoo applies fraud-detection, anti-abuse and fair-use monitoring measures to the Phone Number Functionality, including (without limitation) automated monitoring of traffic patterns, volumes, destinations, costs and behavioural signals. Without prejudice to any other right or remedy of adigoo under these Terms or applicable law:

where adigoo reasonably suspects fraudulent, abusive, unlawful or non-compliant use of a Phone Number, any breach or attempted breach of the KYC requirements, or any other risk to adigoo, its carrier partners, the numbering plan, other users or third parties, adigoo may, with or without prior notice and at its sole discretion:

temporarily suspend the Phone Number, the Phone Plan and/or your Account;

block specific traffic, destinations or features;

impose usage limits;

require re-performance of the KYC procedure;

request additional information or documents; and/or

terminate the Phone Number Functionality, the affected Phone Plan and/or your Account;

you shall remain responsible for all charges and costs incurred by adigoo as a result of any fraudulent, abusive, unlawful or non-compliant use originating from your Account, your device(s) or your credentials, including pass-through costs charged by carrier partners, numbering authorities, regulators or third parties, except to the extent such use is demonstrably attributable to adigoo’s gross negligence or wilful misconduct;

adigoo reserves the right to cooperate with, and to share information with, regulators, law enforcement, carrier partners, numbering authorities and other competent third parties where required by law or where reasonably necessary to investigate or prevent fraud, misuse of Numbering Resources, or breach of these Terms.

Regulatory compliance and changes. The Phone Number Functionality is subject to applicable telecommunications, electronic-communications, anti-money-laundering, anti-fraud, sanctions, consumer-protection and data-protection laws and regulations, and to the rules of the relevant national numbering plan and underlying operators. adigoo may, at any time and with reasonable notice where practicable, modify, suspend, restrict or discontinue any aspect of the Phone Number Functionality (including the geographical scope, the Phone Numbers available, the Phone Plans offered and pricing) in order to comply with such laws, regulations, regulator orders, court orders, carrier or numbering-authority decisions, or to address changes in technical or commercial feasibility.

Phone Number Functionality charges. For the Phone Number Functionality, the amounts payable may comprise:

• the Number Reservation fee for the reservation period selected at purchase (e.g., monthly, quarterly, half-yearly, yearly, or such other periods as set out in the Offering);
• the price of any Phone Plan selected by you, whether purchased simultaneously with the Number Reservation or separately during the reservation period;
• any out-of-bundle, premium-rate, special-service or non-included usage charges, where supported and disclosed in the Offering; and

any taxes, levies, regulatory fees, universal-service contributions and other public charges imposed in connection with telecommunications services in the relevant country/region.

Applicable taxes, levies and regulatory fees will be displayed at point of sale to the extent required by applicable law.

If it is determined that a Free Trial offer has been used more than the permitted number of times by the same individual, device, or email address, we reserve the right to immediately terminate access to any Services derived from that free trial coupon, and any benefits (e.g., credits) provided as a result of the Free Trial will also be revoked. Additionally, we may limit user to just one Free Trial or promotion for any paid Services and will not allow the combining of Free Trials or other promotional offers.

Suspension and termination by us. We reserve the right to suspend and/or terminate the Account/purchased Services (with or without notice) of any users who violate any applicable laws or these Terms, whether it is a repeated violation or a single instance.

We may suspend (while clarifying or investigating your actions) or terminate your Account and/or your access to the Services where:

you fail to complete the KYC procedure within the timeframe specified in the Offering or during periodical KYC re-evaluation, or your KYC information cannot be successfully verified;

adigoo has reasonable grounds to believe that any KYC information is false, misleading, incomplete, fraudulent, or has materially changed without timely notification;

adigoo reasonably suspects fraudulent, abusive, unlawful or non-compliant use of the Phone Number Functionality, including (without limitation) any of the categories listed in the Acceptable Use of the Phone Number Functionality;

use of the Phone Number Functionality from your Account causes or is likely to cause adigoo or any of its carrier partners or any numbering authority to incur regulatory liability, sanction, fine, complaint, carrier-imposed cost or reputational harm;

a competent regulator, court, law-enforcement authority, carrier partner or numbering authority requests, orders or recommends such action; or

you breach any provision of these Terms in connection with the Phone Number Functionality.

Upon such termination, no refunds will be issued for any unused data/plans, remaining Subscription periods or any accumulated credits related to the Services. Upon termination of the Phone Number Functionality, the Phone Number will be released and placed into Quarantine in accordance with these Terms. adigoo does not guarantee that the same Phone Number will be made available or reallocated to you in the future.

In the event of termination by us, we also reserve the right to refuse the creation of a new Account or to deny the provision of Services in any capacity.

Termination by you. You can terminate agreement with us and revoke your right to the Services at any time by notifying us as per clause 6.2.3.

If, before depletion or expiration of purchased Services, you notify us of termination because we can no longer provide the Services to you, unrelated to any action by you, you may request a refund of the proportional value of unused Services. Otherwise, termination does not entitle you to any refund.

To terminate, email us at support@adigoo.com from the email address associated with your Account or contact our support through chatbot via App – termination process will be initiated subject to Account verification.

Revocation of Services. Upon termination of your Account, or cancelation, depletion or expiration of your Services - whether purchased as a standalone plan or through a Subscription - your access to the Services, including any additional Services (such as Security Features or Extras) as part of the applicable Data Plan, will be immediately revoked.

Number release and Quarantine. You may end your use of a Phone Number at any time by cancelling the Number Reservation or by not renewing it.

In addition:

once your Number Reservation expires, is cancelled, suspended for non-payment, or terminated for any reason in accordance with these Terms, and the Phone Number is disassociated from your Account, the Phone Number will be released and placed into Quarantine in accordance with applicable numbering-plan rules and underlying carrier practices;

a released Phone Number cannot subsequently be re-allocated to you or to any other user by adigoo. adigoo makes no representation, warranty or undertaking that any released Phone Number can be reassigned or reactivated, whether for your benefit or otherwise, at any time;

accordingly, if you intend to use the Phone Number for two-factor authentication, account recovery, as a primary contact number, for binding to third-party services, or for any other use case requiring continuous and uninterrupted possession of the same Phone Number, you are solely responsible for selecting a Number Reservation and a Phone Plan of sufficient duration to cover the entirety of such intended use, and for timely renewing the Number Reservation prior to its expiry. adigoo shall not be liable for any loss, damage or inconvenience caused by your inability to access any third-party account, service or communication as a result of the release, Quarantine or non-reassignment of a Phone Number;

where, exceptionally and at adigoo’s sole discretion, a Phone Number that has not yet entered Quarantine could be reassigned, adigoo may (without obligation) facilitate such reassignment subject to applicable regulatory constraints and to any additional fees specified at that time.

Jurisdiction. These Terms shall be governed by, and construed in accordance with, the laws of the Hong Kong Special Administrative Region, without reference to its choice of law rules. However, some countries (including countries of the European Union) have laws that require contracts to be governed by the mandatory provisions of the local laws of the consumer’s country. In such cases, mandatory provisions of the local laws of your country of residence apply.

Judicial Resolution of Disputes. Before filing a claim against adigoo, please try to resolve the dispute informally by sending us a written notice of dispute at support@adigoo.com that includes your name, a detailed description of the dispute, and the relief you seek. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved, you or adigoo may bring a formal proceeding. You and adigoo agree that any judicial proceeding to resolve claims relating to the Terms will be brought in the courts of the Hong Kong Special Administrative Region. If you reside in a country (including countries of the European Union) where laws provide consumers the right to bring disputes in their local courts, in such cases, mandatory provisions of the local laws of your country of residence apply. We always strive to address your concerns without needing a formal legal case.
